संविधानलाई देशको मूल कानुन मानिन्छ । कानुन सबैको लागि अपरिहार्य रहेको छ । ब्यक्तिदेखि राष्ट्र प्रमुख सबैले विधिको शासनमा रहनु पर्ने हुनाले त्यस्तो विधि कस्तो रहने, के कसरी संचालन गर्ने भन्नाको खातिरको लागि संविधानलाई देशको मूल कानुन मानिन्छ । संविधान देशको मूल कानुन भएकोले संसारमा सबै देशले लिखित रुपमा संविधान निर्माण गरेका छन । अपवादमा वेलायतबाहेक सबै राष्ट्रले आफ्नो राष्ट्रिय आवश्यकताअनुसार एकात्मक, संघात्मक, राजतन्त्रात्मक, लोकतन्त्रात्मक वा जुनसुकै तन्त्रको शासन पद्धति अंगालेको देशले पनि संविधान बनाएको हुन्छ ।
नेपालको कुरा गर्दा संबैधानिक विकासको क्रममा वर्तमानको गणतान्त्रिक संविधान २०७२ नेपालको सातौं संविधानको रुपमा रहेको छ । राणा शासनको समय अवधी १०४ वर्षसम्म नेपालमा कुनै पनि प्रकारको लिखित संविधान थिएन । राणा शासकको मौखिक आदेश नै संविधान रहने तत्कालिन समयमा जनताको जन आक्रोसलाई साम्य पार्न राणा प्रधानमन्त्री पद्मशमसेरले सर्वप्रथम नेपाल सरकारको वैधानिक कानुन २००४ घोषणा गरे । यो नै नेपालको पहिलो लिखित संविधानको रुपमा रहन गयो । त्यसपछि प्रजातन्त्र स्थापना पछि नेपालको अन्तरिम संविधान २००७ लागु गरियो । पहिलो जन निर्वाचित सरकारले निमार्ण गरेको बहु पार्टि पद्धतिको नेपाल अधिराज्यको संविधान २०१५ र राजा महेन्द्रले एक दलिय पंचायती शासन ब्यवस्थाको सुरुवात गरी नेपालको संविधान २०१९ प्रजातन्त्रको पुन स्थापना गरी सवैधानिक राजतन्त्र सहितको बहुदलीय शासन ब्यवस्था भएको नेपाल अधिराज्यको संविधान २०४७ र नेपालको पहिलो गणतान्त्रिक संविधान, नेपालको अन्तरिम संविधान २०६३ तथा संघीयतालाई स्वीकार गरेको वर्तमानको नेपालको संविधान २०७२ गरी नेपालमा सातवटा संविधानको प्रयोग भइसकेको अवस्था छ ।
जुनसुकै प्रकारको शासकीय स्वरुपले पनि देशको विकासमा फरक पार्दैन केवल संविधानको पालनकर्ता र कार्यकारी प्रमुखको दायित्व, कर्तब्य र निजको इच्छा शक्तिमा भर पर्ने हुन्छ । जतिसुकै दफा, उपदफा र लिखित भएको संविधान पनि कसरी रद्दीको टोकरीमा नेतृत्वकर्ताले पुर्याउँछन र जनता र प्रजातन्त्रको नाम दिएर संविधानको रक्षाको निम्ति भन्दै शासन सत्तामा पुग्छन् ।
विश्व इतिहासको संविधानलाई हेर्ने हो भने संसारकै सवैभन्दा लामो भारतीय संविधान र संसारकै छोटो अमेरीकी संविधान तथा अलिखित वेलायती संविधान रहेको छ । संविधान मात्रले पनि देशको उन्नती र प्रगतिमा खासै फरक पार्दैन भन्ने उदाहरण ती संविधानको शासकीय स्वरुपबाट पनि प्रष्ट हुन्छ । ७० वर्षिय नेपालको संविधानले देशको विकासमा कुनै प्रभाव पारेको छैन । जुनसुकै प्रकारको शासकीय स्वरुपले पनि देशको विकासमा फरक पार्दैन केवल संविधानको पालनकर्ता र कार्यकारी प्रमुखको दायित्व, कर्तब्य र निजको इच्छा शक्तिमा भर पर्ने हुन्छ । जतिसुकै दफा, उपदफा र लिखित भएको संविधान पनि कसरी रद्दीको टोकरीमा नेतृत्व कर्ताले पु्याउँछन र जनता र प्रजातन्त्रको नाम दिएर संविधानको रक्षाको निम्ति भन्दै शासन सत्तामा पुग्छन भन्ने उदाहरण म्यानमार, पाकिस्तान लगायत देशको विगत र वर्तमानको शासन ब्यवस्था र प्रशासनबाट थाहा हुन्छ ।
जुन देशमा राजनीतिले कल्याणलाई प्रवद्र्धन गर्न सकेको छ । ती देश र समाज मानव विकासको सूचीमा सदा माथि रहने गरेका छन । मुलुकको शासन प्रणालीमा जनताको वढीभन्दा बढी सहभागिता गराउने खालको ब्यवस्था अवलम्वन गरिएको अवस्थामा मात्र जनताले आप्mनो स्वामित्वको अनुभुित गर्छन र मेरो सरकार भन्ने भावना जागृत हुन्छ । नेपालमा विविधायुक्त समाज रहेकोले यहाँका सबै जाति, भाषा, धर्म संस्कृति, विचार आदिलाई समेटी शासन प्रणालीमा सबैको समानुपातिक रुपमा प्रतिनीधित्व गराउन सकेको अवस्थामा मात्र शासनमा सबैको अपनत्व महसुस हुनेछ । संविधानको स्वरुपले मात्र देश बन्दैन निम्न वर्गलाई जवसम्म राज्यको मूल प्रवाहमा समावेश गर्न सक्दैंन तवसम्म संविधान कागजको दस्तावेज मात्र हुन जान्छ ।
नेपालको वर्तमान शासकीय स्वरुप वेलायती वेस्ट मिनिष्टर पद्धतिमा आधारित संसदीय शासन ब्यवस्था रहेको छ । यो शासन पद्धति संसदीय शासन पद्धतिमा रहेको र संसदीय शासन पद्धति उत्कृष्ट मानिन्छ । सरकार प्रमुख र राष्ट्र प्रमुख एकै ब्यक्ति हुने शासन प्रणाली वा राष्ट्रपतीय शासन प्रणाली पनि एक प्रकारले संसदीय शासन प्रणाली मानिन्छ । संसदीय शासन प्रणालीमा साधारणतया सरकार प्रमुख र राष्ट्र प्रमुख फरक फरक ब्यक्ति हुन्छन । नेपालमा बारम्बार उठ्ने गरेको प्रश्न राजनैतिक स्थिरता, बिकास र समृद्धि रहेको सन्र्दभमा नेपालले संसारकै प्रजातान्त्रिक शासन ब्यवस्था मानिने संसदीय शासन पद्धति अपनाएको भएतापनि शासनको नेतृत्वकर्ता वा कार्यकारी प्रमुखले राजनैतिक र शासनको स्थिरता कायम गर्न नसकेको देखिन्छ । कार्यकारी प्रमुखले संसदको सर्वोच्चताको कारण र संसदमा संसदीय अंक गणितको कारणले आपूmले अनुकुल वातावरणमा काम गर्न नपाएको भन्दै प्रधानमन्त्री गिरिजा प्रसाद कोइरालादेखि मनमोहन अधिकारी हुदैं वर्तमानमा संसदको दुईतिहाई संसदको सर्मथन प्राप्त खड्ग प्रसाद ओलीसम्मले संसदलाई विघटन गरेको पाइन्छ ।
विश्वमा खासगरिकन संसदीय शासन प्रणाली राष्ट्रपतिय शासन प्रणाली र मिश्रित शासन प्रणाली गरी यी तीन प्रकारका शासन प्रणालीको प्रचलन रहेको छ । राजतन्त्रात्मक वा सैनिक शासन प्रणाली पनि मूल रुपमा यी नै शासन प्रणालीमा आधारित रहेर शासन गरेका छन । कार्यकारी प्रधान रहने प्रणाली राष्ट्रपति शासन प्रणाली हो । यस्ता प्रणालीमा सरकार प्रमुख र राष्ट्र प्रमुख एकै ब्यक्ति हुने गर्दछन र जनताको प्रत्यक्ष मतबाट निर्वाचित भएका हुन्छन मुलुकको सम्पूर्ण कार्यकारी शक्ति राष्ट्र प्रमुखमा रहेको हुन्छ । संसदीय शासन प्रणालीमा संसदको सर्वोच्चता नै मुख्य हुने हुनाले कार्यकारी प्रमुखको छनौट संसदले गर्ने र राष्ट्र प्रमुख अलंकारिक रुपमा रहने र राष्ट्र प्रमुखलाई एकताको प्रतिकको रुपमा राख्ने गरीन्छ । संसदीय शासन प्रणालीमा पनि खासगरी २ वटा पद्धति रहेको हुन्छ । पहिलो वेष्ट मिनिष्टर शासन प्रणाली अर्को सहमतीय शासन प्रणाली । यसैगरी तेस्रो शासन प्रणालीको रुपमा मिश्रित शासन प्रणाली रहेको हुन्छ । यस शासन प्रणालीमा राष्ट्र प्रमुख र सरकार प्रमुख दुवैले कार्यकारिणी अधिकार प्रयोग गर्न पद्धति अवलम्वन गर्ने गरिएको हुन्छ । यस्तो शासन पद्धति अँगाल्ने मुलुकहरुमा सामान्यतया प्रत्यक्ष रुपमा निर्वाचित राष्ट्र प्रमुख र संसदको बहुमत प्राप्त ब्यक्ति सरकार प्रमुख हुने गर्दछन । यो प्रणाली तत्कालिन संविधानकारहरुले अमेरीकाको राष्ट्रपतीय पद्धति र वेलायतको संसदीय पद्धति दुवैको गुणहरुलाई समेटि वीचको बाटो अवलम्वन गर्दै नयाँ खालको राजनैतिक प्रयोग गर्न खोजेको पाइन्छ ।
विद्यमान शासकीय प्रणालीलाई परिवर्तन गरी सहभागी मुलक लोकतन्त्रलाई स्वीकार गरी जनताबाट निर्वाचित प्रत्यक्ष कार्यकारी प्रधानमन्त्रीको प्रणालीमा जानुपर्दछ । संसदलाई प्रभावकारी बनाउन जनताबाट निर्वाचित र निश्चित मापदण्ड तयार गरी छरितो सांसद संस्थाको राष्ट्रियसभा र प्रतिनिधिसभाको दुई सदनात्मक संसदको ब्यवस्था गर्नुपर्दछ ।
नेपालको वर्तमान संविधानमा देखिएको हालको निर्वाचन सम्बन्धी संवैधानिक ब्यवस्था राजनैतिक अस्थिरताको दस्तावेज बन्न पुगेको छ । नेपालमा वर्तमान संविधानको यहि ब्यवस्था रहेसम्म यहाँ कुनै पनि एउटै दलले स्थाई बहुमत प्राप्त गर्न सोच्नु मुर्खता सिवाय अरु केही हुदैंन । संविधान सभालाई मिश्रित भनिएको वर्तमान संविधानमा संघीय र प्रदेश सभाका निर्वाचन प्रणाली अस्थिरताको प्रतीक बन्न पुगेको छ । संघीय संसदमा ३३४ जना सांसद मध्ये प्रत्यक्षतर्फ १६५ र समानुपातिकतर्फ ११० जना निर्वाचित हुने ब्यवस्था गरिएको छ । संघीय संसदमा बहुमत प्राप्त गर्न १६८ वा सो भन्दा बढी संख्या हुनुपर्ने ब्यवस्था छ । समानुपातिकतर्फ रहेको ११० जनाको संख्या दलले पाएको मतको आधारमा हुने भएकोले निर्वाचनमा सहभागी हुने पार्टि वा दलले समानुपातिक रुपमा मत प्राप्त गर्ने हुनाले कुनै पनि पार्टिले प्रत्यक्षतर्फ बहुमत प्राप्त गरेतापनि समानुपातिकको कारणले सम्पुर्ण संख्यामा बहुमत प्राप्त गर्न अत्यन्तै कठिन देखिन्छ । समानुपातिक र जनताद्धारा प्रत्यक्ष निर्वाचित प्रणालीको खिचडी प्रणाली नै पार्टीको एकल बहुमतको लागि बाध्यताको रुपमा रहेको छ । जसले गर्दा एकल पार्टिले बहुमतको अभावमा मिलीजुली पार्टि शासन नेपालको शासन प्रणाली र संसदिय प्रणाली रहने देखिन्छ ।
समानुपातिक सांसदको अवधारणा नेपालको सन्दर्भमा जहान परिवारमा सिमित हुदैं गयो । साला, साली, श्रीमती, पे्रमिका अनि ब्यापार गर्ने कार्य थलो भैंm खरिद बिक्रिको रुपमा समानुपातिक सांसद परिभाषित हुदैं गए । राजनीतिमा त्याग, विषयको दक्षता, विज्ञता आदि कुनै पनि योग्यता नचाहिने विकृत सांसद समानुपातिक सांसद हुदैं गए । स्वयंम सांसद भएकालाई समेत संसद, सांसद र आफ्नो कर्तब्यसमेत जानकारी नहुन विडम्वनाको पक्ष रहृयो । समृद्धि र विकासको लागि राजनैतिक स्थिरता अत्यन्त आवश्यक हुन्छ । नागरिकको कोणबाट हेर्ने हो भने स्थिरता भनेको तोकतान्त्रिक, सामाजिक, आर्थिक स्थिरता हो । सन २०१९ को तथ्याङ्क अनुसार राजनैतिक स्थिरताको परिसूचाङ्कमा १९५ मुलुक मध्ये नेपालको अवस्था १३६ औं स्थानमा छ । यसबाट पनि प्रष्ट हुन्छ कि देशमा राजनैतिक स्थिरता कायम हुन नसक्दा समृद्धि र विकास संभव छैन ।
